INEC Produces Documents requested by PDP to Kebbi Guber Tribunal

Peoples Democratic party (PDP) Governorship Candidate Bande Aminu and his political party PDP in Kebbi State have putting INEC Chairman, Professor Muhamud Yakubu on noticed via Tribunal Subpeona to produce form EC9 that was filled and submitted in the year 2023 by Abubakar Umar Tafida as 3rd Respondant and Form CF 001 filled and submitted in the year 2015 by same Abubakar Umar Tafida to the said Commission, before to Kebbi Governorship Election Petition Tribunal Sitting in Birnin Kebbi.
On today’s proceedings, Petitioners Led Counsel M. Y. Abdullahi SAN, informed the Tribunal that via office of the Tribunal Secretary they where Informed that the Subpeoned witness from INEC Headquarters is around, he therefore seek the leave of Tribunal to allow the Subpeoned witness to tender documents asked to be produce from the said INEC before the Honourable Tribunal.
However, he told the Tribunal that he is to tender the documents and not to testify as it was stated in section 218 and 219 of the Evidence Act. The Tribunal granted the said leave having no any objection from both 1st to 4th Respondants Counsels.
The Subpeoned witness, introduced himself as Samuel Omale Assistant Director with the Department of legal Drafting and Documentation at Independent Electoral Commission (INEC) Headquarters Abuja.
He further stated that” there was a subpoena of this Honourable Tribunal send to the chairman of the said Commission requesting him to produce some documents filled and submitted to the said Commission by the Abubakar Umar Tafida.
Adding that “the documents listed in the Subpeona send to commission to produce documents are as follows: 1. Form EC9 filled and Submitted by Abubakar Umar Tafida in the year 2023.
2. Form CF 001 filled and submitted in the year 2015 to the same Commission by same Abubakar Umar Tafida. Stressing that, that’s the documents listed in the Subpeona to be produced by the commission to the Honourable Tribunal.
The Tribunal chairman asked the 1st, 2nd, 3rd and 4th Respondants Counsels if there’s any objection to the documents produced by INEC Headquarters Abuja.
On the part of Counsels to all the Respondants, Said they have no objection to the Subpeona send to the commission, but they are objecting to the admissibility of the documents produced and reserved their arguments till final written address.
Thereafter, Tribunal admitted the documents and marked it as Exhibits B713 and B715 respectively. Than Counsel to petitioners seeks the Tribunal to discharge the Subpeoned witness. Later the witness discharged and hearing continued with normal witnesses.
