JUST IN: Kebbi Guber Tribunal Affirms Election of Gov. Nasir Idris, dismisses PDP Petition

Kebbi State Gubernatorial Election Petition Tribunal Sitting in Birnin Kebbi have affrimed the Election of Gov. Nasir Idris and his deputy Abubakar Umar Tafida conducted by Independence National Electoral Commission INEC on 18th April 2023.

This was stated in the tribunal while delivering its judgement lead by Honourable Justice OFem I Ofem on Thursday 5th October in Birnin Kebbi, where its says that 36 witnesses has failed woefully to proof over voting rather, in their evidence during cross examination they maintained that election was conducted peacefully, score was entered correctly to all the political parties.

However, the tribunal chairman in his judgement also point out that they have not established over voting or non accounting of ballots in their respective evidences. Having elicited this evidence from the Petitioners witnesses, tribunal is of the view that Petitioners have fails to proofs over voting and non accounting of ballots.

Equally, 28 witnesses called by Petitioners that testified in respect of ballots accounting and non signing of election results has not linked or speak on the documents tendered through the bar, meaning tribunal have found that the Petitioners have only dump the said documents before tribunal which the tribunal can’t act upon a document that was not linked to a case or speak on to support claims. So the documents is hereby struck out.

Tribunal said ” All the Petitioners witnesses and the documents they tendered didn’t proved all the issues and allegations they raised in their petition and also issues for formulated for the determination by the tribunal. However having tribunal found that petitioners witnesses and their documents didn’t support their claims is hereby struck out.

Similarly, tribunal reaffirmed that Petitioners evidence and witnesses confirmed that election was conducted in compliance with the electoral act as Amended 2022, by way of maintaining in the evidence during cross examination that” election was conducted peacefully and results score by parties was entered correctly”. Tribunal explained.

Having tribunal analysized and weight both evidence of Petitioners and that of respondants and some paragraphs struck out in the petition called for in the preliminary objections raised and urged by respondants and having found that evidence of Petitioners doesn’t Support what they have canvassed and claimed before tribunal and the Petitioners most show cause why tribunal should give judgement in their favor. But Petitioners in this petition have fails woefully to established all issues raised.

On the hold tribunal found that the Petitioners petition lack merits and is hereby dismissed for failure to proved issues they predicted their petition. The tribunal is hereby affirming the election of Gov. Nasir Idris and his deputy Abubakar Umar Tafida as duly elected governor of Kebbi state.
